These General Terms and Conditions govern the terms, manner and conditions for the purchase and sale of goods through the website https://viviscal-store.com, hereinafter referred to as “the website”, owned by TRIPING Ltd, UIC 112588352, registered office and registered address. TRIPPING, registered office and address: , Sofia, ul. 4 “Nikolay Rakitin”, contact telephone number: 02/9438090, hereinafter referred to as the “Seller” and any natural or legal person using the website to place orders for the purchase of goods and hereinafter referred to as the “User”.
By using https://viviscal-store.com to purchase goods, you are deemed to accept and agree to the Terms and Conditions described below.
І. Subject
1. The Website provides the user with information about products and the opportunity to purchase the goods offered in the online store, by placing an order and paying the relevant sales price, in strict compliance by the user with these General Terms and Conditions and the legislation in force. The online shop provides basic information about the products offered, which includes a description of the main characteristics and an image of each product, the selling price, including all taxes and fees, information on the method of payment, delivery and performance of the contract.
2. The vendor strives to display the colours of all products as accurately as possible, but since the colours the user sees on their monitor also depend on the monitor itself / on the colour settings, and even on the angle at which the image is viewed on the monitor / the vendor cannot guarantee that the user’s monitor will display the true colours, sizes and shapes.
II. Purchase and Sale
3. The publication of the main characteristics of the offered goods and their selling price on the website constitutes, in its essence, a public invitation within the meaning of Article 290, paragraph 1 of the Commercial Law to make a purchase order in accordance with them.
4. The Seller does not guarantee the availability of the ordered items. In the event of inability to fulfill its obligations due to the reason that it does not have the goods requested for purchase in stock, the seller, within 3 / three / working days after receipt of the purchase order, shall notify the user – by phone call to the phone number specified in the registration form or by sending a message to the email specified by the user – about the exhaustion of the goods and the possibility to change the order at its request.
5. In the event of an incorrect or wrong address, contact person and/or telephone number when submitting the order “TRIPPING” Ltd via “https://viviscal-store.com” is not bound by any obligation to perform the order.
6. The user has the opportunity to make a purchase of the goods offered by the website after performing the following factual actions:
6.1. Enter the online store at https://viviscal-store.com/;
6.2. choice of item by type, size and price;
6.3. clicks the “Order” button, this action constitutes an expression of intent which binds the consumer and the seller expressly with the force of a contract;
III. Prices and method of payment
7. All prices on the website are quoted in a currency convenient to the user, inclusive of all taxes and charges, per item and do not include shipping costs.
8. The price and delivery costs shall be added to the order value according to the announced scheme.
9. Payment methods:
9.1. In cash / cash on delivery / by the user or by a third party on behalf of the customer;
9.2. By bank transfer to the bank account of TRIPING Ltd. after issuing a pro forma invoice;
9.3. By credit and debit card, through the payment systems “MyPost” or “PayPal”;
10. Orders over 1500 BGN shall be paid in advance by bank transfer or the payment systems “MyPost” or “PayPal”;
IV. Delivery
11. Within 3 working days after confirmation of the request, if the product itself is not otherwise specified. In the event that a product in the store has a delivery date other than the above, the date mentioned in the product shall be accepted. The ordered goods shall be delivered to the address indicated by the user.
V. Refusal
12. The consumer has the right to refuse to receive the goods he has requested for purchase when:
12.1. The goods delivered clearly do not correspond to the consumer’s purchase order and this can be ascertained by simple inspection;
12.2. The goods have been damaged in transit. In this case, the consumer must contact the courier, who is obliged to draw up a report of damage to the shipment.
13. The user has the right, without compensation or penalty and without giving any reason, to withdraw from the concluded contract within 14 /fourteen/ working days.
14. If the consumer refuses within the specified period, the consumer must notify the seller and return the goods in their original packaging, with the original labels, without any indication that the goods have been used or unpacked, without being damaged or treated in any way. The cost of returning the goods shall be borne by the buyer. In this case, the seller shall reimburse the consumer the price paid by him no later than 30 /thirty/ days from the date on which the consumer has exercised his right to withdraw from the contract.
VI. Rights and Obligations of the Parties
15. The Seller is obliged to deliver the ordered goods in their undamaged integrity and to transfer the ownership of the goods.
16. The user is obliged not to submit fictitious or invalid orders, to indicate an accurate delivery address, email address for correspondence and contact telephone number, and in case of a valid order to pay the price of the goods ordered, as well as the cost of delivery.
17. The User is obliged to provide access and the possibility of receiving the goods. The goods ordered for purchase shall be delivered to the delivery address indicated by the User within the time period provided in the information on delivery and payment of goods. The goods shall be delivered suitably packaged according to their type and transport for delivery. Upon delivery of the goods, the User or a third party shall sign the accompanying documents. A third party is considered to be anyone who is not the holder of the application but accepts delivery of the goods and is at the address specified by the User. In case of refusal to receive the goods, except as described below, the refusal shall be deemed unjustified and the User shall be liable for the costs of delivery and return of the goods. In this case, the User shall indemnify TRIPING Ltd. for all damages and lost profits, including any other costs beyond the cost of delivery and return of the goods, incurred as a result of the refusal. In the event that the User is not found within the delivery period at the specified address or access and conditions for delivery of the goods are not provided within this period, TRIPING LTD shall be released from its obligation to deliver the goods ordered for purchase. The user may confirm his/her wish to receive the goods after the expiry of the delivery period in which he/she was not found at the address, bearing all delivery costs. In this case, a new delivery period starts accordingly from the moment of confirmation.
VII. Personal data
18. “TRIPPING” Ltd. through “https://viviscal-store.com/” takes due care to protect the personal data of the User, which became known when completing the electronic form for making a purchase application. This obligation is waived if the User has provided false data.
Subject to applicable law and the provisions of these General Terms and Conditions, TRIPPING Ltd. may use the User’s personal data solely for the purposes set out in the contract.
19. “TRIPPING” Ltd. through “https://viviscal-store.com” may not use the information to offer goods and/or services to the User, for promotions, sending greetings, organizing raffles, inquiries, for statistical and any other lawful purposes, except in the case of express consent of the same. . Any other purposes for which the data is used will comply with Bulgarian and European legislation, applicable international acts, Internet ethics, rules of morality and good morals.
20. “TRIPPING” Ltd. through “https://viviscal-store.com” undertakes not to disclose any personal data about the User to third parties – state authorities, commercial companies, individuals and others, except in cases where:
20.1. has obtained the user’s express written consent;
20.2. the information has been requested by public authorities or officials who are authorised to request and collect such information under applicable law;
20.3. “TRIPPING Ltd is obliged to provide the information by law.
VIII. Copyright
21. All texts, images, photographs and articles published on this website are copyrighted and protected by the Copyright and Related Rights Act and subsidiary applicable Bulgarian and foreign legislation. Their use without the express consent of the author is contrary to Bulgarian law.
IX. Responsibility
22. “TRIPPING Ltd. through “https://viviscal-store.com/” shall not be liable for any failure to perform its obligations under this Agreement in the event of circumstances which TRIPPING Ltd. through “https://bg.viviscal-store.com/” did not foresee and was not obliged to foresee – including, but not limited to, cases of force majeure, fortuitous events, problems in the global network of the Internet and in the provision of services beyond the control of TRIPPING Ltd..
X. Changes to the General Terms and Conditions
23. These Terms and Conditions may be unilaterally modified by the Seller. Changes to the General Terms and Conditions shall not affect the relationship between the Seller and the User arising in connection with a valid purchase order(s) submitted prior to the changes to the General Terms and Conditions.
For matters not covered by these General Terms and Conditions, the provisions of the legislation in force shall apply. All disputes between the parties will be resolved amicably. If no agreement is reached, the dispute shall be referred to the competent court.
